Transparent Delimitation of Constituencies emphasized by Chief Justice of Pakistan

The Chief Justice of Pakistan (CJP), Umar Ata Bandial in a case hearing has directed the Election Commission of Pakistan (ECP) to conduct the delimitation of constituencies in a clear and open manner, so all the participants of the electoral process are convinced of its transparency and state no objections over the delimitation process.

Chief Justice Umar Ata Bandial’s remarks came during a hearing on Tuesday, where a division bench led by CJP, was hearing petitions pertaining to the delimitation of provincial assemblies PS7, 8, and 9 in Shikarpur, Sindh. In 2018, all three delimitations were challenged and on Tuesday, 15th August 2023, the Hon’ble Division bench addressed the issue in a clear and open fashion.

CJP’s remarks on Delimitation of Constituencies

While hearing the case, the Hon’ble Chief Justice of Pakistan, Mr. Umar Ata Bandial highlighted the importance of constituency delimitations since it has been a recurring topic in the apex court. He emphasized that instant issue holds public interest at its core and needs to be heard on merit.

The CJP stressed the fact that the election commission is directed to ensure that the delimitation process in the cited constituencies is transparent and impartial so everybody must believe that justice was seemed to be done.

Moreover, he stressed upon the delicacy of the situation, that a slight modification of the delimitation process of provincial or national constituencies can affect the outcome of the voting, therefore, strictly directed the local representative otherwise known as ‘tapedar’ that he/she shall be highly meritorious and comply with all the merits of the delimitation.  

While hearing the case, CJP inquired about the schedule for the upcoming general elections. In response, Director General (Law) Mr. Muhammad Arshad, appeared not certain about the election date. The CJP directed the election commission to address all unresolved election issues well in advance of the general elections, stressing the transparency of polls.

The Chief Justice on stage also pointed out his concerns about the delimitation process in Sindh, since on former occasions, many questions were raised by the contesting political parties as well as independent candidates on delimitation’s accuracy in their provincial constituencies.

After hearing the matter at length, the Hon’ble Division Bench headed by CJP, Umar Ata Bandial remanded the matter back to the Election Commission of Pakistan for resolving delimitation issues afresh, implying that now the responsibility of delimitation lies with ECP.
