Understanding the Ongoing Legal Saga of Chaudhry Pervaiz Elahi repeated arrests
In Pakistani politics, one name has been making headlines repeatedly and that is Pervaiz Elahi, the President of the Pakistan Tehreek-e-Insaf otherwise known as PTI. Today we’ll discuss the intricate details of Chaudhry Pervaiz Elahi repeated arrests, legal battles and the recent Islamabad High Court’s decision for suspension of his detention under Section 3 of the Maintenance of Public Order (MPO).
June – Detention saga began
In June, Series of Detentions Began for Pervaiz Elahi, when he was taken into custody by the Anti-Corruption Establishment (ACE) on allegations of kickbacks in multiple development projects. Despite being relieved by the Lahore Court, he again faced the rearrests by the Anti-Corruption establishment in similar cases. Political experts have stated over twitter and on their social platforms that since Chaudhry Pervaiz Elahi joined PTI, his political demise seem imminent on the political landscape in Pakistan.

Illegal recruitment’s case in Punjab Assembly
Despite being discharged by a Lahore court, he faced rearrest by the ACE in a similar case in Gujranwala. When the ACE was exhausted, it was another round of arrest for his alleged involvement in illegal recruitments in the Punjab Assembly, the biggest province’s assembly.
Roller-coaster ride of Chaudhry Pervaiz Elahi repeated arrests throughout July
Throughout June and July, the roller-coaster continued for Elahi on the legal front. Elahi, after getting relief in illegal recruitment case, is held accountable from the National Accountability Bureau (NAB) in an inquiry for alleged embezzlement in several development projects across Punjab. It is pertinent to mention that various courts have granted him relief, but the state is adamant to detain and involve him in other legal complexities.
No Independence Day for Ellahi
On August 14, 2023, when entire country was celebrating Pakistan Independence Day, National Accountability Bureau, Lahore office decided to take former chief minister Punjab into custody in connection with a graft case. Though, the arrest by NAB, Lahore was short-lived, as the Hon’ble Islamabad High Court directed the concerned department to release him on September 1, 2023.
Suspension of MPO Detention
When everything went haywire for the state, the good old MPO detention came into play for Pervaiz Elahi. Against the MPO detention, Pervaiz Elahi’s legal team immediately approached the Islamabad High Court and the took the verdict in their favour against the detention U/s 3 of MPO. It is appropriate to state that 3 MPO allows the government to detain individuals deemed harmful to public safety or public order.
Violation of Directives of Lahore High Court
In the court order, the Lahore High Court explicitly called the arrest illegal and in violation of the directives issued by the LHC. Consequently, Elahi was directed to be released forthwith. However, the Lahore High Court imposed conditions on Pervaiz Elahi’s release. The Lahore High Court directed the former CM Punjab not to participate in any unlawful activities and work toward implementation of law on the citizens of pakistan in a manner that it does not seem so evident that it is supporting a specific party.
Upcoming Hearing & Chaudhry Pervaiz Elahi repeated arrests
After his rearrests, the Deputy Commissioner, Islamabad and Pervaiz Elahi, both are expected to appear in person at the next hearing, which has been adjourned until September 12. Moreover, Pervaiz Elahi’s repeated arrests and legal battles have raised severe concerns about the rule of law and the blatant use of detention orders against dissidents in Pakistan.
The Islamabad High Court’s decision to suspend detention of Pervaiz Elahi is a significant development on the political landscape of Pakistan, but this legal drama is far from over.
